Nuj Terms of Service
PLEASE READ SECTION 14. It contains a binding arbitration agreement and a class-action waiver. They affect how any dispute between you and Nuj gets resolved, and they limit your right to go to court or to take part in a class action. You can opt out of arbitration within 30 days. Section 14 explains how.
1. Who we are, and what this covers
Nuj is operated by Nuj App LLC, a limited liability company organized under the laws of the State of California (“Nuj,” “we,” “us”).
These Terms are a binding agreement between you and Nuj. They cover the Nuj mobile apps, trynuj.com, our SMS coaching, our emails, and everything else we make (“the Service”), and they include our Privacy Policy and, if a student on the account is under 13, our Children’s Privacy Notice, both of which are part of this agreement. We ask everyone who uses Nuj to accept these Terms before they can use the Service. By accepting them, creating an account, or subscribing, you’re agreeing to all of it. If you don’t agree, don’t use the Service.
We may update these Terms. If a change is material, we’ll give you notice by email and post the new version with a new effective date before it takes effect. Continuing to use the Service after that means you accept the update, except that a material change to how we collect or use information from a student under 13 requires new verifiable parental consent, and continued use will not substitute for it. We log which version of these Terms you accepted, and when.
We may also add, change, or discontinue any feature of the Service, with or without notice. If we discontinue the Service entirely, Section 13 tells you what happens next.
2. Who’s allowed to use Nuj
If you’re the parent or guardian buying for a student: you must be 18 or older and legally able to enter a contract. When you set up a student account, you’re confirming three things: you’re the parent or legal guardian of that student, the contact information you gave us for them is accurate, and they know you signed them up. That’s what lets us email and coach them.
Students accept these Terms themselves. Every student who uses Nuj accepts these Terms in their own name, including the arbitration agreement and class-action waiver in Section 14. A student who buys Nuj for themselves accepts at purchase. A student invited by a parent accepts at first sign-in, before they can use the Service. We record that acceptance the same way we record a parent’s.
Parents also agree on the student’s behalf. When you create a student account, you accept these Terms for yourself and, so far as you are able, on behalf of the student, and you represent that you have the authority to do so, including the authority to agree to the arbitration provision in Section 14. We’re entitled to rely on that representation without independently verifying it. The student’s own acceptance is what we rely on first; yours is a backstop.
When a student turns 18. If a student joined Nuj as a minor, we’ll ask them to accept these Terms again in their own name once they turn 18, and they’ll need to do that to keep using the Service.
If you’re a student signing up for yourself: you must be at least 13 years old and in 9th grade or above. If you’re under 18, you need your parent or guardian’s permission, and by signing up you’re telling us you have it.
Students under 13 can only be added to Nuj by a parent or guardian, and only with the consent described in our Children’s Privacy Notice. Kids under 13 can’t create their own Nuj accounts.
We can refuse service, close accounts, or remove content at our discretion. For example, if we believe someone is under the required age, misrepresented their authority, or is misusing the Service. We’re entitled to rely on the age, identity, and authority information you give us, and we’re not liable for acting on information that turns out to be false.
3. Your account
Parents and self-signup students can sign in with Google, with Apple, or with an email and password. A student invited by a parent doesn’t set a password. They sign in with a magic link sent to their email. Whichever applies to you:
- Keep your credentials to yourself. You’re responsible for what happens under your account, whether or not you authorized it, except where the misuse resulted from our failure to maintain reasonable account security.
- Give us accurate information and keep it current.
- Tell us right away at customersupport@trynuj.com if you think someone else got in.
A parent account and a student account are separate accounts with separate logins, even when one person pays for both. That separation is deliberate. See Section 7.
4. Money
Where you buy Nuj
All Nuj subscriptions are purchased through the App Store or Google Play. There is no other way to subscribe. That means Apple or Google, not Nuj, is the merchant on your transaction. They take your payment, they run the billing, and they own the subscription controls.
Practically, this is what it means for you:
- We never see your payment details. Not your card number, not your billing address, nothing. We couldn’t charge you if we tried.
- Your subscription lives in your platform account, under Subscriptions in your Apple ID settings or your Google Play account.
- Your purchase is also governed by Apple’s or Google’s terms, in addition to these Terms. Where their rules control the transaction, theirs win over ours on that transaction.

Additional students are annual only. There’s no monthly add-on. You can have up to 3 students on one parent account.
Prices are in US dollars, may change prospectively as described below, and don’t include tax. Tax is calculated and collected by the app store at checkout, according to where you are. We don’t offer free trials.
Auto-renewal, in plain terms
Your subscription renews automatically. Annual plans renew every year on your purchase anniversary. Monthly plans renew every month. The app store charges the payment method on your platform account at the then-current price until you cancel. You authorize that recurring charge when you subscribe, and the app store shows you the renewal terms before you confirm.
We’ll email you a receipt for every renewal, and for annual plans we’ll email you a reminder 30 days before the charge lands. The app store sends its own receipts and reminders too, so expect both. Ours are the ones that explain what’s happening with your student’s coaching.
If we change the price
If we raise the price of your plan, we’ll email you at least 30 days before it takes effect, and the new price applies at your next renewal. Apple and Google also run their own price-change process, which in most cases asks you to agree to the new price before they’ll charge it. If you don’t want to continue at the new price, cancel before the renewal date.
Cancelling
You cancel through your app store, not through us. We can’t do it for you, and we can’t do it on your behalf if you email us. Here’s where it lives:
- iPhone or iPad: Settings, then your name, then Subscriptions, then Nuj, then Cancel Subscription.
- Android: the Google Play app, then your profile icon, then Payments and subscriptions, then Subscriptions, then Nuj, then Cancel subscription.
No retention maze on our side, and no “are you sure” gauntlet. We don’t get to put one in front of you even if we wanted to.
Cancelling stops the next renewal. It does not end your current period. You keep full access until the period you already paid for runs out, unless Apple or Google refunds your purchase or otherwise revokes your access, in which case access ends when they tell us.
After that there’s a 6-day grace window. During it, the student’s data is still there and you can resubscribe without losing any progress, and the parent account stays readable. Once the window closes, access ends and deletion proceeds on the schedule in our Privacy Policy.
Refunds
Nuj does not issue refunds, because Nuj cannot issue refunds. Apple and Google hold the money and control refunds entirely. If you want one, you ask them:
- Apple: reportaproblem.apple.com
- Google: the Google Play refund request form in your order history
Whether they grant it is their decision under their policies, not ours. We have no ability to approve, deny, or override it, and we don’t get a vote.
Cancel-anytime is the off-ramp we control, which is why we make sure you know how to cancel, send reminder emails on annual plans, and always send renewal receipts.
Additional students
If you’re paying for more than one student and you cancel the primary subscription, the add-on students end at the close of the same period. A parent who wants an add-on student to keep going has 6 days from that cancellation to start a new primary subscription for them. Progress stays attached to the Nuj student account, not to whichever app-store account paid, so nothing is lost. Cancelling just an add-on leaves the primary subscription running.
A parent can also deactivate an individual student without cancelling the subscription. That stops all Nuj messaging to that student and preserves their data on our normal retention schedule.
If a payment fails
The app store handles this. Apple and Google retry the charge on their own schedule and give you a grace period to fix the payment method. During that window we’ll keep your student’s access on where we can, and we’ll email you so you’re not caught by surprise. If the platform ultimately can’t collect, the subscription lapses and access stops.
5. Text messages and notifications
SMS coaching is a core part of how Nuj works, so read this bit.
What we send. All Nuj SMS is service-tier: coaching prompts tied to your paid subscription, verification codes, account security, and activation reminders. It’s not marketing, and consenting to it is never a condition of buying Nuj.
Consent. We collect a phone number only when the person whose phone it is enters it themselves, and we verify it with a one-time code before we send anything else. That verification is your opt-in, and you’re representing that you’re the subscriber or customary user of that number, or, for a student’s number, that you have the authority a parent or the student themselves would have to provide it. The first content message you get includes the standard compliance line.
Message and data rates may apply. Message frequency varies with how you use the product.
Reply STOP to stop. Reply HELP for help. STOPhalts all Nuj SMS to that number until you text START, and you can also tell us to stop any other reasonable way, including by email or in the app. It doesn’t cancel your subscription. Coaching switches to push notifications in the app instead. Carriers aren’t liable for delayed or undelivered messages.
Push and email. Push notifications need your device’s permission, and you can turn off whole categories in the app or shut them all off in your OS. One kind can’t be individually switched off while you have an account: account and security notifications, meaning verification, password reset, and payment problems. Marketing emails have an unsubscribe link in every one. Transactional emails such as receipts, security alerts, and billing notices aren’t optional while you have an account, because you need them.
6. What Nuj is, and what it isn’t
Nuj helps students build executive functioning skills such as planning, task initiation, and focus, through assessments, activities, and coaching prompts.
Nuj is not medical care. Nuj does not diagnose, treat, cure, or prevent any medical or psychological condition. It is not therapy, not counseling, not psychiatric care, and not a substitute for any of them. Our assessments, including our 36-item screener derived from the Executive Skills Questionnaire-Revised (ESQ-R), are educational and self-reflective tools. They are not a diagnostic instrument, and a Nuj score is not a diagnosis of ADHD, an executive function disorder, a learning disability, or anything else. Nothing in the Service is medical, psychological, legal, or educational advice, and you shouldn’t treat it as a substitute for the judgment of a qualified professional.
If you have a health concern about yourself or your child, talk to a qualified professional. If someone is in crisis, contact emergency services or a crisis line. Nuj is not equipped for that and does not monitor messages for emergencies.
No promises about outcomes. We believe in the research behind this and we cite it honestly, but we don’t guarantee any particular improvement in grades, skills, behavior, test scores, or admissions outcomes. Results depend on the student, and you assume the risk of relying on Nuj for anything beyond its stated purpose as an educational coaching tool.
HSA/FSA. Nuj subscriptions are sold through the app stores, which do not support health-savings or flexible-spending payment methods. If we ever add a path that does, whether your expense qualifies is between you, your plan administrator, and the IRS. We don’t determine eligibility and we don’t issue letters of medical necessity.
7. Using Nuj responsibly
Please don’t:
- Share your account, resell access, or use one subscription for someone it wasn’t bought for
- Copy, scrape, republish, or redistribute our assessments, activities, or content
- Reverse-engineer the Service, or hammer it with bots and automated requests
- Break into anything, upload malware, or interfere with other people’s use
- Impersonate someone, lie about being a parent or guardian, or misrepresent a student’s age
- Try to get around any age screen or parental-consent step
- Use Nuj for anything illegal, or in a way that harms a minor
We can suspend or terminate an account that does any of this, immediately and without notice where we reasonably believe it’s necessary. Suspension doesn’t entitle you to money back, and in any case refunds are the app store’s call, not ours.
8. Who owns what
Ours. The Service, the Nuj name and logo, our curriculum, activity content, assessment framing, scoring logic, software, and design are owned by Nuj or our licensors and protected by IP law. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose while your subscription is active. No other rights are granted.
Yours. Your assessment responses, reflections, and anything else you type stay yours. You give us a license to use that content to run the Service, meaning to score it, personalize your coaching, show it back to you, and improve the product, as described in our Privacy Policy. If we ever use it to improve our models or content, it’s de-identified and aggregated first. We don’t sell it and we don’t hand it to advertisers.
Feedback. If you send us an idea for making Nuj better, thank you, and we can use it freely with no obligation to you.
9. Third parties
We run on other people’s infrastructure: Apple and Google for app distribution, sign-in, payments, and subscription management, Twilio for SMS, and the vendors listed in our Privacy Policy. Their terms apply to their piece of it, and we’re not responsible for their services. If we link out to a third-party site, that’s not an endorsement.
10. The service is provided as-is
To the fullest extent the law allows, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free. We don’t warrant that the Service will meet your expectations or produce any particular educational, behavioral, or academic result.
Some states don’t allow disclaiming implied warranties. If you live in one, this section applies only as far as that state permits.
11. Limits on what we owe you
To the fullest extent the law allows, and regardless of the legal theory asserted, whether contract, tort, warranty, statute, or otherwise:
- Nuj is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost opportunities, even if we knew such damages were possible.
- Our total liability for any claim relating to the Service is capped at the greater of (a) the amount you paid for Nuj in the 12 months before the claim arose, or (b) $100.
- This limit applies in the aggregate to all claims arising out of or relating to the Service, and is a fundamental basis of the bargain between us.
Nothing here limits liability that can’t be limited by law, including for fraud, willful misconduct, or death or personal injury caused by our negligence. Nothing in this Section limits any right or remedy available under Cal. Civ. Code § 1798.150 or any other provision of the California Consumer Privacy Act, or any other right that cannot be waived or limited by law.
Some states don’t allow these limits. If you live in one, they apply only as far as that state permits.
12. You cover us for your misuse
You’ll indemnify and hold harmless Nuj, its members, officers, employees, and agents from claims, damages, and reasonable legal fees arising out of your breach of these Terms, your misuse of the Service, content you submit, your violation of any law or third party’s rights, or, for parents, a claim that you didn’t actually have authority over the student account you created. This Section does not apply to a student who is under 18.
13. Ending things
You can cancel any time through your app store (Section 4). You can also ask us to delete your account entirely. See the Privacy Policy.
We can suspend or terminate your access if you breach these Terms, if we suspect fraud, or if we stop offering the Service. If we shut the Service down entirely, we’ll give you reasonable notice and work with Apple or Google on refunds of the unused prepaid portion of your current period, though the final call on any refund rests with them.
Sections 8 through 15 survive termination.
14. Disputes: arbitration and no class actions
This section affects your legal rights. Please read it. Talk to us first. Before starting anything formal, email legal@trynuj.com with a description of the problem and what you want. We’ll try to resolve it within 60 days. Most things end here.
Nuj will pay the arbitration filing, administration, and arbitrator fees, so that you pay no more than $250 in total arbitration fees regardless of what the applicable rules would otherwise require, and we will pay within the time California law requires. The remedies in Cal. Code Civ. Proc. §§ 1281.97 to 1281.99 apply in full if we miss a payment deadline, and you may elect any remedy those statutes provide. Nothing in these Terms limits any remedy the arbitrator may award that a court could award under applicable law.
No class actions. You and Nuj each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim, and only that claim, must proceed in court, and the rest of this section still applies to everything else.
Public injunctive relief. Nothing in this Section waives your right to seek public injunctive relief. A claim for public injunctive relief may be brought in court, and will be stayed until any individual claims subject to arbitration are resolved. If this paragraph is found unenforceable, it is severable from the rest of this Section, and the remainder of this Section stays in force.
Mass filings. If 100 or more similar claims are filed by or with the assistance of the same law firm or coordinated group of claimants within a 60-day period, the parties agree the claims will be resolved through a coordinated process: a small number of cases will proceed first as bellwether arbitrations and the rest will be stayed, consistent with the administering provider’s mass-arbitration procedures. All limitations periods are tolled for every stayed claimant for as long as the stay lasts. No stay will last longer than 180 days, after which any stayed claimant may elect to proceed in individual arbitration or in court. Bellwether outcomes are not binding on any claimant who did not participate in them.
Small claims. Either of us can bring a qualifying individual claim in small claims court instead.
You can opt out. You have 30 days from your own first acceptance of these Terms to opt out of arbitration by writing to legal@trynuj.com. Any clear written statement will do. A student who accepts these Terms has their own 30-day window running from their own acceptance, and a parent may exercise it for them. If we materially change this Section, you get a fresh 30-day window. Opting out costs you nothing and doesn’t affect anything else in these Terms. If you opt out, Section 15 governs.
Carve-outs. Either party may seek injunctive relief in court to protect intellectual property.
Disputes about a charge. This section covers disputes between you and Nuj. A dispute about a payment, a renewal, or a refund is between you and Apple or Google, and their terms govern it.
15. The legal housekeeping
Governing law. These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Where Section 14 doesn’t apply, the state and federal courts in Santa Clara County, California have jurisdiction and you consent to that, except that you may bring a qualifying individual claim in the small claims court for the county where you live.
Severability. If a provision is unenforceable, the rest stays in force.
No waiver. If we don’t enforce something right away, we haven’t given up the right to enforce it later.
Assignment. You can’t assign these Terms without our written consent. We can assign them in a merger, acquisition, or sale of assets.
Entire agreement. These Terms plus the Privacy Policy and the Children’s Privacy Notice are the whole agreement between us about the Service, and supersede any earlier agreement about it.
Notices. We may give you notice under these Terms by email to the address on your account or by posting in the Service. You can give us notice at legal@trynuj.com.
Electronic communications. You agree that we may communicate with you electronically, and that any notice, agreement, or disclosure we provide electronically satisfies any legal requirement that it be in writing.
Relationship of the parties. You and Nuj are independent parties. Nothing here creates a partnership, joint venture, employment, or agency relationship.
Apple and Google. Apple and Google are not parties to these Terms, but each is a third-party beneficiary of them and may enforce them against you. Neither has any obligation to provide support or maintenance for the Service.
Force majeure. We’re not liable for delays or failures caused by things outside our reasonable control.
